Special Immigrant Juvenile Visa (SIJ)

An unfortunate truth is that sometimes a juvenile needs to petition for lawful permanent residency without a parent due to abuse, neglect, or abandonment. In these cases a court may grant a Special Immigrant Juvenile (SIJ) classification. To qualify for SIJ Classification you must meet the following requirements:
  • Be under 21 years of age
  • Currently reside in the United States
  • Have a valid juvenile court order that finds
    • You cannot be reunified with one or both of your parents due to abuse, abandonment, neglect, or a similar basis and;
    • Returning to the country of nationality or last habitual residence of you/your parents is not in your best interest
  • Be eligible for USCIS consent
  • Have written consent from the Department of Health and Human Services (HHS)/ Office of Refugee Resettlement (ORR) to the court’s jurisdiction if
    • You are currently in the custody of HHS and;
    • The juvenile court order also changes your custody status or placement.

U-Visas

UVisas are available to victims of certain crimes who have helped law enforcement or government officials investigate said crimes. You may be eligible for a U-Visa. Marriage / Family Based Petition (I-130)

An I-130 petition is to be filed, by a United States Citizen, on behalf of a non-citizen relative to immigrate to the United States and obtain a green card.

As the petitioner, you must indicate whether the beneficiary requests adjustment of status from inside the United States or consular processing outside the United States.

If your Form I-130 is still pending with USCIS and you want to change your selection you may contact the USCIS Contact Center and request a change.

Who is Eligible to File an I-130?

A U.S. Citizen may file for:

  • Spouse
  • Unmarried children under 21 years of age
  • Unmarried sons or daughters 21 years of age or older
  • Married sons or daughters of any age
  • Brothers or sisters (you must be 21 years of age or older)
  • Mother or Father (you must be 21 years of age or older)

If you are filing multiple petitions, you must file a separate I-130 for each relative.

A Lawful Permanent resident may file for:

  • Spouse
  • Unmarried children under 21 years of age
  • Unmarried sons or daughters 21 years of age or older

Violence Against Women Act (VAWA)

Despite the name of this act, VAWA provides protections for all victims of abuse, stalking, domestic violence, dating violence, and sexual assault.

To qualify for VAWA, the petitioner must have a qualifying relationship with a United States Citizen or Lawful Permanent Resident (LPR) such as:

  • Spouse, intended spouse, or former spouse
  • Child of
  • Parent of a U.S. citizen son or daughter that is 21 years of age or older


A petitioner must have been subjected to battery or extreme cruelty by the U.S. citizen or LPR during the qualifying relationship. Spouses may also be eligible based on the battery or extreme cruelty to their child.
