Marriage / Family Based Petition (I-130)

An I-130 petition is to be filed by a United States Citizen on behalf of a non-citizen relative to immigrate to the United States and obtain a green card.

As the petitioner, we must indicate whether the beneficiary requests adjustment of status from inside the United States or consular processing outside the United States.

If your Form I-130 is still pending with USCIS and you want to change your selection, we may contact the USCIS Contact Center and request a change.

Who is eligible to file an I-130?

A U.S. Citizen may file for:

  • Spouse
  • Unmarried children under 21 years of age
  • Unmarried sons or daughters 21 years of age or older
  • Married sons or daughters of any age
  • Brothers or sisters (you must be 21 years of age or older)
  • Mother or Father (you must be 21 years of age or older)

If you are filing multiple petitions, you must file a separate I-130 for each relative.

A Lawful Permanent Resident may file for:

  • Spouse
  • Unmarried children under 21 years of age
  • Unmarried sons or daughters 21 years of age or older

What is Needed to File an I-130, Petition for Undocumented Relative

We use this petition to help your eligible relative apply to immigrate to (or remain in) the United States and apply for a Green Card. Filing for or approval of this petition does not give your relative any immigration status or benefit.

To file for an I-130 Petition, we must provide the following information:

  • Evidence of U.S. citizenship, lawful permanent residence, or U.S. national status. Documents can include;
    • A copy of your birth certificate
    • A copy of your naturalization or citizenship certificate
    • A copy of Form FS-240, Consular Report of Birth Abroad (CRBA)
    • A copy of your unexpired U.S. passport
    • An original statement from a U.S. consular officer verifying that you are a U.S. citizen with a valid passport
    • A copy of the front and back of your Permanent Resident Card (also known as a Green Card or a Form I-551)
  • Evidence of a qualifying familial relationship. Documents can include;
    • Petition for a Child: A copy of your child(ren)’s birth certificate(s)
    • Petition for a Parent: A copy of your birth certificate
    • Petition for a Sibling: A copy of your and your sibling(s)’ birth certificate(s)
    • Petition for a Spouse:
      • Evidence of your marriage’s bona fides (validity)
      • A copy of your marriage certificate (with evidence of previous terminated relationship, for both you and your spouse, if applicable)
      • Documentation showing your joint ownership of property
      • A lease showing joint tenancy, meaning you both live at the same address
      • Documentation showing that you have combined your financial resources
      • Birth certificate(s) of child(ren) born to you and your spouse together
      • Affidavits sworn to or affirmed by third parties validating your marriage. Each affidavit must contain the full name and address of the person making the affidavit; date and place of birth of the person making the affidavit; and complete information and details explaining how the person acquired their knowledge of your marriage
      • Any other relevant documentation to establish that you have an ongoing marital union
    • An Adopted Child:
      • A copy of the adoption decree stating the adoption took place before your child turned 16 (or 18 if the sibling exception applies)
      • Evidence that you have had legal custody of your child for at least 2 years
      • Evidence that you have lived with the adopted child for at least 2 years
      • Evidence that the Hague Adoption Convention process does not apply – if you or your spouse is a U.S. citizen and the child is from a Hague Adoption Convention country
  • Proof of Legal Name Change (If applicable)
  • 2 Passport Style Photographs
