What Are K Visas?
K visas are nonimmigrant visas that allow foreign nationals to enter the United States based on their relationship with a U.S. citizen.
K-1 Visa: Fiancé(e) of a U.S. Citizen
- Allows the foreign fiancé(e) to enter the U.S.
- Must marry within 90 days of entry
- After marriage, can apply for Adjustment of Status (green card)
K-2 Visa: Children of K-1 Visa Holders
- Accompanies the K-1 visa
- Children under 21 may enter with or follow the fiancé(e)
K-3 Visa: Spouse of a U.S. Citizen
- Designed for spouses waiting abroad while their I-130 petition is processed
- Allows early entry to the U.S. to wait for green card processing
K-4 Visa: Children of K-3 Beneficiaries
- For unmarried children under 21 of K-3 visa holders
Note: K-3/K-4 visas are less commonly used today due to processing shifts in USCIS and the State Department.
Who Is Eligible For A K Visa?
To qualify for a K-1 visa, you must:
- Be a U.S. citizen petitioning for your fiancé(e)
- Intend to marry within 90 days of their arrival
- Have met in person within the past 2 years (with limited exceptions)
- Be legally free to marry
- Demonstrate a bona fide relationship
To qualify for a K-3 visa, you must:
- Be legally married to a U.S. citizen
- Have a pending Form I-130 filed with USCIS
- Intend to live together in the U.S.

How long does a K-1 visa take to process?
Processing typically takes 10–14 months, depending on USCIS and consular backlogs.
Can my fiancé(e) work in the U.S. on a K-1 visa?
Yes, once they file for an adjustment of status they can apply for work authorization. As soon as the work authorization is approved, they can work.
Do K-1 visa holders have to leave if we don’t marry in 90 days?
Yes. If the marriage does not occur within 90 days, the visa holder becomes out of status and may be subject to removal.
